AES Indiana Rate Freeze: What the September 8 IURC Deadline Means for Your 2027 Power Costs

We have been tracking the AES Indiana rate case since July. On August 12, AES Indiana filed a motion asking the IURC to pause all decisions in the pending docket while former Commissioner Andy Zay's lawsuit against Governor Braun works through the courts.

Here is the mechanism that is being underreported. AES is using Braun's own alleged conduct as a legal shield. By pointing to Zay's allegations, including a June 15 call from the state's energy secretary and a June 18 meeting where Braun reportedly asked how the commission was going to "fix this", AES has positioned any subsequent commission order that reduces its rates as legally vulnerable to appeal. Kerwin Olson, executive director of the Citizens Action Coalition, stated that AES's motion "implies strongly that they intend to litigate" if the commission acts to reduce the rate.

The practical consequence for manufacturers in AES territory: if the IURC misses the September 8 reconsideration window, the $71 million rate increase locks in by default, including an $8.50-per-month residential hike set for January 2027. The commercial and industrial step-up is proportional and now represents the operative baseline for 2027 power cost planning.
