Former IURC Commissioner Andy Zay filed suit in Marion Superior Court Monday, alleging Governor Braun's office attempted to influence the active AES rate case and unlawfully removed him from the commission. Representative Carey Hamilton put the operator-relevant exposure plainly: if courts find that Braun's office engaged in prohibited ex parte communications during an active rate case, AES could use that procedural taint to challenge any adverse rehearing ruling, potentially locking the current $71 million rate increase in place while litigation drags past the January 2027 Phase 2 implementation date. AES has already committed not to file another base rate case until 2030.

September 8 is the IURC rehearing deadline and the hinge point for this entire situation. Commissioner Ziegner is now the sole pre-Braun appointee remaining on a board that has turned over almost entirely in eight months. Duke Energy Indiana's three-year rate plan filing is mandated for December 2026 under HEA 1002, meaning this same commission will also shape that case.
